Kelley Clements Keller is the owner and managing member of The Keller Law Firm, LLC, a boutique firm practicing intellectual property (IP), which includes assisting clients in IP prosecution, procurement and maintenance, licensing and enforcement, brand expansion and management, domain name and Web site matters, social media issues, and IP-related business matters. 6:30 a.m.:  I begin each day with coffee with my husband. Once I put the coffee on, I check my e-mail to see what is brewing for the day. This is my first engagement with the day’s material. I send out responses to the messages that require immediate response, and shoot out e-mails to the staff, letting them know about the new projects that need to be added to the queue. 8:30 a.m.:  I arrive at the office already aware of the business for the day. I review my calendar and prioritize, and then I check in with my attorneys and staff- the law clerks, my paralegal, and my research assistant. The purpose of this crucial part of my morning is to ensure that everyone is on the same page, and that each person has the tools that they need to succeed in their assignments. 9:00 a.m.:  I give one of my law clerks an office action refusal from the U.S. Patent and Trademark Office (PTO) for one of our client’s trademark applications for him/her to begin researching and drafting a response. It’s a difficult argument to make, as it requires us to prove that our client’s house mark is descriptive, as opposed to generic, in order to secure federal protection. 9:30 a.m.:  I am counsel in an interesting trade secret action where the defendant did not file an answer to the federal complaint. I place a call to a colleague to discuss the status of the case, since two heads are always better than one. I have come to learn that no matter how long you practice law, you never “experience it all.” We debate the likelihood of whether our client can recover attorneys’ fees under the circumstances, e.g., a request for default was entered by the Clerk of Court and a motion for default judgment is pending with the judge. Because the defendant failed to answer, the case law is a bit murky on how much our client can recover, if anything at all. It’s a very interesting fact pattern!     10:00 a.m.:  I’ll spend the next few hours in phone conversations with clients, court personnel, offices (such as the PTO), or in outreach, marketing, and business development. When not on the phone, I’m sending and responding to numerous e-mails. When I encounter particular situations that reflect important principles in IP, I like to call my staff together for a quick tutorial. Such situations represent opportunities for learning, and my role as a teacher and mentor to my staff is very important to me as it gives me the opportunity to demonstrate why these principles result in predictable outcomes. 10:30 a.m.:  I need to make a call to the PTO to handle a clarification of a client’s identification of goods with the examining attorney assigned to their trademark application, and ask my paralegal and one of my law clerks to step into my office and listen to the call for learning purposes. This is something I often do and find that my staff is more knowledgeable of files they work on as a result of it. The examining attorney enters the requested changes into the record, and my paralegal knows that she needs to draft a reporting letter to the client regarding this activity. 11:00 a.m.:  Being the owner of the firm, I also have to manage the business in addition to practicing law. I have my usual daily meeting with my comptroller and get a financial update on our receivables and payables. In a given day, I might also spend an hour on the phone with my certified public accountant on various financial matters. If there are IT issues, I ask someone on the staff to contact our service providers to handle them. If there are any building issues, e.g., problems with heating, these also require my time and attention. It’s surprising how much time can be spent on the “business of law,” rather than the “practice of law.” 12:00 p.m.:  Lunch is a time for business development, and when I’m not eating with the staff (or at my desk- a “no no”), I spend this time meeting with colleagues to work on collaboration or marketing, or meeting with potential clients. In the afternoon, I continue with more phone calls and e-mails, research for my caseload, and drafting letters to clients, opposing counsel, or relevant agencies 12:45 p.m.:  I prepare for an initial consultation meeting and review my notes from my phone conversation with the new client. At this time, I am unaware of the potential client’s product, but do know that she thinks patent protection applies. We will know more after the consultation. 1:00 p.m.:  The potential client arrives and our meeting begins. I soon realize that trademark protection is most applicable, possibly copyright, but definitely not patent. Intellectual property is a confusing area of law to many, so initial consultations can be very educational. We discuss the product she wants to take to market, her overall branding goals, and how I can assist her in accomplishing these goals. We also discuss finances related to the representation. 2:00 p.m.:  With the meeting fresh in my mind, I draft a follow-up e-mail to the potential client, confirming what was discussed as well as laying out her various legal options. I find these e-mails give clients a good picture of the strategy that we outlined and how to plan accordingly. 3:00 p.m.:  I continue to work on pending matters, such as follow-up e-mails with clients, at present drafting a motion for attorneys’ fees in the trade secret infringement case, and reviewing/approving client correspondence that my paralegal has prepared. It’s not uncommon for my mornings to be full of client phone calls, e-mails, and meetings, leaving the afternoon for knocking out substantive legal work. 5:00 p.m.:  I e-mail the draft motion for attorneys’ fees to co-counsel for his review. Co-counsel responds and would like to set up a time to connect at the end of the week. 6:00 p.m.:  I begin to wrap up my work for the day and shut down the office, taking care of issues from pressing business and legal matters to mundane tasks such as doing dishes, washing out the coffeemaker, and turning out the lights (welcome to owning your own firm!). I also like to acknowledge the work completed by my staff, so I shoot off a final few e-mails before calling it a day around 7:00. Off to dinner with my husband, glass of Shiraz in hand!

Millennials want to do things in ways that Generation X and the baby boomers may not agree with, and that often causes friction. Many companies are so focused on the what of the matter that they may be missing out on the why. Older executives often find it easy to dismiss the millennial generation as lazy or unmotivated, but that simply isnt the case. Millennials grew up in the age of the internet; for as long as they can remember, theyve been able to talk to anyone from anywhere at any time. They keep their professional email accounts connected to their personal cellphones, and they perform one-off work tasks at all hours. They want to wear comfortable clothes to work, and they want to work at least some of the time from home. Many millennials got participation trophies in their soccer leagues just for trying their best; theyve learned from an early age that rankings  dont matter much.  Thats why the office hierarchy means less to them, as does the prospect of climbing the corporate ladder. They want environments where ideas and effort rule more than people do. These ideas that millennials hold about work arent bad â€" theyre just different from the traditional notions  that boomers are so used to. While the two generations might view the workplace in different ways, learning to reconcile  the two ideologies with one another will bring benefits to  any employer that supports the effort. Millennials are starting their careers at a time when digital and cultural shifts have created a blending of work and life, says Sherry Dixon, senior vice president at employment agency Adecco Staffing USA.  Nine-to-five schedules are becoming a thing of the past, while smartphones and cloud-based platforms are holding workers accountable for to-do lists, deadlines, and hot requests at all hours of the day. Many millennials are willing to stay connected and responsive outside of the eight-hour work day, but they may also expect employers to be more lenient when they need to work from home or take an afternoon off at the last minute. As long as young people have established trust, accountability, and consistent communication with their managers, this new dynamic can work in both the employees and employers favor. Meeting of the Minds If boomers and millennials have limited interaction, theyll never find out how much they can learn from each other. Companies that encourage employees to close the generational gap will reap  some serious rewards Programs that foster idea-sharing are often used as a tactic to strengthen workplace culture, but they are also great ways for businesses to absorb technical know-how from millennial workers, Dixon says. Companies can also implement reverse mentoring programs, where executives spend time with less-tenured employees to hear their fresh perspectives. Besides reverse mentoring, businesses can implement additional programs that encourage employees to teach one another across generational lines. Companies can leverage young workers by conducting quarterly lunch and learns, Dixon says. During these sessions, an office orders in lunch and dedicates the hour to an employee or team who will share best practices or introduce new topics. These not only generate positive morale, but can also tap into millennial expertise. Millennial Wanderlust When you have top millennial talent on your roster, you want them to hang on to their jobs the way baby boomers did in days of yore. But thats easier said than done. Millennials arent just known for changing jobs â€" they also like to change locations. People are not getting married and settling down as young as they used to, allowing them to pick up and move more easily, Dixon says. Adeccos recent  Way to Work  survey found that 53 percent of people between the ages of 18 and 24 expect to move to 2-3 cities throughout their careers. On top of that, millennials have grown up in the age of startups and many seem to possess a more entrepreneurial spirit, which may be contributing to their desire to experience different career opportunities and new geographies â€" especially in places like Los Angeles and New York that are home to notable fast-growing and forward-thinking companies, Dixon says. Millennials consider the opportunity for growth a top concern at the start of their career journey. In the Way to Work survey, 36 percent of young people said growth was a top priority in their job hunt. It makes sense that millennials would be driven to seek out new work environments in order to keep expanding their skill sets and advancing in their careers, Dixon adds. While that fact may make any effort to get millennials to stay at one company seem futile, the truth is that millennials are interested in staying at companies where they feel engaged and appreciated. No matter the industry, companies must provide transparent and consistent feedback to millennials in order to keep them engaged, Dixon says. They need to know how their particular responsibilities are contributing to the bottom line and that they are adding value to the organization. Any doubt that they are making a difference, and they will look for other options to ensure they are investing their time where it counts. And this doesnt mean that millennials only want positive feedback; in their pursuit to advance, they are looking for ways to improve their performance. Most importantly, businesses must remember that they dont have the upper hand in the current job market. In todays economy, candidates and employees can always seek other opportunities. Companies are recruiting in a job seekers market right now, so competitive compensation packages are a must, Dixon explains. But salary isnt the end of the conversation. Once an employer gets millennial talent in the door, a winning workplace culture is necessary in order to get them to stay put. Make Connections to What You Already KnowIn the book  Damn Right: Behind the Scenes with Berkshire Hathaway Billionaire Charlie Munger, Munger noted that:“If you get into the mental habit of relating what you’re reading to the basic structure of the underlying ideas being demonstrated, you gradually accumulate some wisdom.” This wisdom is the fundamental idea or “first principles” of what you’re reading.For example, whilst reading the book  Blink: The Power of Thinking Without Thinking  by Malcolm Gladwell, I realized that the key ideas reminded me of the concept of a highly focused mental state called “Flow,” which I’d previously read through the work of psychologist, Mihly Csíkszentmihlyi.As another example, whilst reading  The Paradox of Choice: Why More is Less, I related the key concepts to scenarios where I’d been overwhelmed by a vast number of food choices on a restaurant menu.By connecting new ideas to familiar concepts, you can retain more of what you read and improve your reading comprehension.Plus, you’ll uncover innovative solutions to familiar problems- because new insights tend to emerge at the intersection of ideas across different domains.Next time you’re reading an important idea in a book, simply ask yourself this question: What does this remind me of?3. Binge Read Similar TopicsAfter reading countless books on similar topics, I’ve discovered that information and knowledge within different books are like branches of a tree.Although each branch may look different, they all emerge from the same trunk.In other words, the fundamental ideas across seemingly different books tend to be similar.Following my ‘eureka’ moment, I devised a technique called “Surrounding the 5.”The concept is simple: I pick the top five most important books on a particular topic and then like surround sound around a listener, I “surround myself around the topic” by reading each book back to front in the  right environment.As an example, when I wished to dive into the topic of philosophy, I began reading the classic books by Aristotle, Plato, Kant, Nietzche, and Jean-Paul Sartre.This helped me to make connections between ideas and remember what I read.Plus, it saved me valuable time and energy that could’ve have been wasted searching for the best books to rea d or reading bad books.When you read the fundamental books on a topic, you build a solid foundation or “tree trunk” to accumulate new ideas that reinforce your existing knowledge on the topic.This improves your reading comprehension and helps you retain more of what you read- because as King Solomon once said, “there is nothing new under the sun.”So whilst new books may appear to contain new information, they all borrow ideas from the same knowledge “trunk.”4. Read Books You Can Apply ImmediatelyOne of the best ways to improve your reading comprehension is to read books that are relevant to your current struggles.For example, if you’re struggling to lose weight and stay in shape, you can read a book like  How to Eat, Move and be Healthy,  and apply the key concepts instantly.This way you’ll accelerate your learning, because all five senses will be immersed in engaging with the new information.Haven said that, not all books are written to be applied in everyday life. But when it can be, ask yourself this question:“What’s the one thing I’m going to apply after reading this book?”By putting into practice what you read, you can retain what you read and bridge the gap between knowledge and wisdom.5. Keep Your Notes and Highlights OrganizedIf you decide to take extensive notes on a book, there are various tools you can use to ensure that you remember what you read.  2I personally keep my notes organized in  Evernote, because they are searchable and easy to access on my mobile phone and laptop.Prior to using Evernote, I’d have my written notes scattered across various notebooks that went missing.This meant that I’d have to rewrite my notes again- an enormous waste of time and energy.Another effective strategy is to highlight key ideas on the  Kindle Paperwhite and then export the notes to Evernote using their web clipper.If you choose to type or handwrite notes from a book, you can use a  reading stand  to keep the book still as you turn t he pages (otherwise, the pages will close and you’d have to keep reopening them, which can be exhausting).6. Listen Slowly For Learning and Fast For EntertainmentListening to audiobooks is a great way to digest information from a book during commutes and whilst completing mundane tasks. But it’s easy to get bored, lose track of what you’re listening to and forget the most important ideas.One of the best ways to remember more information from audiobooks is to slow down the speed throughout learning portions of the book and increase the speed throughout entertainment portions.Let me explain.Most non-fiction authors tend to fill up a significant portion of their books with stories, statistics and exercises, designed to keep the reader engaged and support key ideas.These fillers are entertaining but not essential.And since nearly 80% of the content within most non-fiction books tends to be filler, you can listen to the audiobook at 1.5-2x speed on  Audible.  3Then, when you reach portions of the book that contain important ideas, simply rewind and slow down the speed throughout this section.This way you’ll save valuable time skipping through the fillers and spend more time absorbing the key ideas in the book.Pro tip:  Use a pair of  wireless headphones  to listen to audiobooks hands-free while exercising, commuting and completing mundane tasks.7. Only Read Good Books You Enjoy (Twice)Eating is like reading.The more junk food you eat, the worse your health and body shape.Likewise, the more bad books you read, the worse your knowledge base will be, and the harder it will be to remember what you read.Too often, we start reading a new book because it’s highly recommended and popular. But that doesn’t mean it’s a good book.And more times than not, we beat ourselves up for failing to finish reading an average book.A better approach is this: don’t bother reading any book that isn’t good.In the book,  How to Read a Book: The Classic Guide to Intelligent Reading, Mortimer J. Adler explains that, “a good book can teach you about the world and about yourself. You learn more than how to read better; you also learn more about life. You become wiser.”After reading a fair share of bad books that left a bitter taste in my mouth, I devised an effective 3-step strategy to help me sift the best from the average books:Step 1:  Quickly read the table of contents to get the “gist”of the book, then skim over the first few paragraphs of the opening chapter and the last few paragraphs of the concluding chapter. Only proceed to the next step if the book appears to be valuable. Step 2:  Skim through the first few paragraphs and the last few paragraphs within specific chapters that are of interest to you. Only proceed to the next step if the book still seems useful to you. Step 3:  Open the book anywhere in the middle and read one full chapter. If you’re still hooked, it’s probably a good book to read back to front.As a general rule of thumb, great books tend to be thought-provoking and leave you feeling slightly exhausted after reading.They don’t just make you more knowledgeable, but also wiser.If the book you’re reviewing passes through all three steps and meets these criteria, then it’s probably worth your time reading the entire book.But we’re not done.Whilst bad books should only be tasted and good books devoured, great books should be chewed and digested thoroughly.In other words, great books should be read more than once. And in the words of the playwright, Oscar Wilde, “If one cannot enjoy reading a book over and over again, there is no use in reading it at all.”  48. Read Before BedA  study  published in  Psychological Science- which explored strategies for improving memory- discovered that sleeping in-between learning sessions not only reduced the amount of practice needed by half, but also increased long-term retention of information.  5During the experiment, the researchers split 60 French-speaking participants into three different groups: a control group, sleep group and no sleep group.Each of them were assigned with the task of learning and remembering French translations of a list of 16 Swahili words.The Control group studied the words in the evening and took the memory test 12 hours after sleeping.The Sleep group also studied the words in the evening and took the memory test 12 hours after sleeping. However, they studied the words a second time.Finally, the No Sleep group studied the words in the morning and took the memory test 12 hours later without sleeping in-between study sessions. Then they studied the words a second time.Afterwards, the researchers conducted follow-up memory tests one week and then six months later.The results: The Sleep group and the Control group both remembered the words better than the No Sleep group.Most surprisingly, the Sleep group remembered more words than both the Control and No Sleep group after 6 months of the memory test.The implication of this study is that sleeping in-between learning sessions can significantly boost memory and reading comprehension.The best way to put this into practice is to read or listen to your book just before you go to bed, and  get a good night’s sleep.To ensure that reading in bed doesn’t disrupt your sleep, you can use a  clip-on warm book light, which will make reading easy on the eyes- and avoid the effects of blue light from lamps and bulbs that cause sleep deprivation.TakeawayBooks are much more than a source of entertainment.They are an investment towards your future self: a gateway to connect with and gain knowledge from the wisest people who are, and were once alive.But more times than not we often treat books in a fleeting manner- reading in a hurry whilst multitasking and tossing them aside afterwa rd.The uncomfortable truth is this: reading is only half the battle. The other half is reflecting on what you’ve read.The best ways to retain what you read and improve reading comprehension, embrace the idea that an equal portion of time spent reading a book, should also be spent thinking and reflecting upon the important ideas you’ve read.But it’s time consuming trying to figure out which books are worth reading and equally challenging to find time to read good books.That’s why I’ve put together a list of the  best audiobooks of  all-time,  which you can listen to during your road trips and commute.Ultimately, as Philosopher, John Locke, once said:“Reading furnishes the mind only with materials of knowledge; it is thinking that makes what we read ours.”  6.FOOTNOTES Excerpt from Bill Gates  interview. Always Keep Learning No one, not even the absolute upper crust of a company hierarchy, knows everything there is to know about business or a particular industry. There is always room to continue learning and growing. Continued education means building your skills and deepening your understanding of the field so that you can progress toward higher levels. Perhaps you can take a professional development class, receive a certification or even go back to school by taking night, weekend   and/or online courses. Any one (or combination) of these are sure to help you learn new information that can be applied to your career field. 2. Be Open to Ideas You are going to learn a lot even if you aren’t in a formal training session. By opening yourself to what your boss, superiors, coworkers and even customers have to say, you can obtain tremendous insight into the way that your position is evolving and what you can do to ensure that you are moving in the right direction. Pay attention during staff and/or company meetings and listen to everyones ideas. Adhere to any feedback from your manager (especially around evaluation times) or even directly approach your manager and ask him/her how you can improve in your role. People who disregard constructive criticism and believe they know it all only harm themselves in   the long run. The people you work with may have a wealth of helpful information and ideas that could positively affect how you perform on the job, but you must be willing to have an open mind and receive the help. 3. Start Where you Are You may have your “eyes on the prize,” but if you don’t pay attention to where you are right now, you are never going to get to the next place along your path. By fulfilling the tasks and responsibilities of your current career to the absolute best of your abilities, you are setting yourself up for a better career. Don’t be afraid to ask for suggestions about how you can do more and do better in your current position- make yourself valuable and they will be willing to work with you as you progress. 4. Build your Network We all know the power of employee referrals. Building your personal and professional network is a powerful and effective way to find and obtain a new, desirable position. First look to your immediate family and friends and then extend your search to professional connections. Word of mouth is great, but dont forget to utilize those on your social networks for possible help. 5. Identify the Next Point on your Timeline Think of your career as a timeline. If someone were to map it out, what would you want mentioned along the way? Figure out what that next point should be, and clearly define it. It is next to impossible to reach a goal that you haven’t really made, and it is almost impossible to make a goal about something that you don’t know you want. If you supervise an accounting team, be sure to offer your appreciation with rewards and recognition. Why? Most businesses can’t survive without a trusted accounting professional. From your staff accountant to your senior accountant, these folks keep the books balanced and taxes filed. As businesses grow, so do the rules and regulations they must follow, and their need for technical expertise multiplies. It’s worth taking a moment on this auspicious day to learn some surprising facts about accountants and give thanks to them appropriately. (See our Slideshare, below.) Why auspicious? International Accounting Day (or International Accountants Day) is celebrated yearly on November 10. That’s the date in 1494 when Venetian mathematician Luca Bartolomeo de Pacioli published an epic tome that included an in-depth look at bookkeeping practices. This work became the foundation for more essays on accounting, eventually earning de Pacioli the title, “The Father of Accounting.” So is this when you hand over that heavy stapler or text thumbs-up dollar signs as an incentive? Not quite. Celebrate your accounting staff Companies around the world have diverse ways of celebrating this special day. Afghanistan will have an international accounting case competition. In Singapore this year, they’ll have a fiesta with carnival snacks, live music and street games, such as Key Punch, where relay participants punch in the numbers on the floor in sequence from 1 to 21. If you’re looking for a less complicated form of recognition, a thank-you card, flowers or balloons may be appropriate. But with just a little more effort, your gestures can be more thoughtful - showing your staff accountants just how much you value their work. Here are few suggestions: 1. Gift certificates Personalizing each certificate is key, whether it’s a restaurant gift card or something more creative. Say your accounting clerk is an avid mystery novel fan. In that case, a gift card to your local independent bookstore would be a thoughtful way to say “thank you.” Or maybe your payroll manager is a football fanatic and would enjoy tickets to a local college’s game. 2. Cash and perks A bump in the paycheck is always a nice show of appreciation. Are you up to date on the pay ranges for finance and accounting positions? Visit the 2018 Robert Half Salary Center and download the Salary Guide. Cash isn't the only reward that carries weight. The possibilities for perks are endless, but one thing employees really like is this: Additional days off. 3. Training and development Offer to pay for a seminar or training. Ideally, the instruction will build new skills that make your accountants’ jobs easier, e.g., learning cloud accounting or preparing for credentials such as the CPA. You might be surprised at how many of your employees are eager for accounting job training at your company. This win-win gift benefits you, your accountants and your organization. 4. Written or verbal praise Take time to write an email or a craft a handwritten note or card to show your thanks. A way to publicly acknowledge truly outstanding performance is by writing something for your company publication. You can also express your gratitude in person, or for larger accomplishments, give your accolades at a staff meeting. Encourage your staff to follow your lead by recognizing each other for jobs well done. Doing this will create a workplace culture of appreciation. 5. Social media tributes Make a personal statement for your accounting staff on Facebook, Twitter, LinkedIn or social media outlet where your organization has a presence. “Happy International Accounting Day” is a good start. But naming specific employees and highlighting their recent work only takes a minute more. This public statement will go a long way toward showing how truly grateful you are. 6. Wish list deliveries Is the department’s copy machine constantly malfunctioning? Is there new software with a great payroll feature? Encourage your accounting staff to make a wish list of items that would make their jobs easier. Then you’ve got your International Accounting Day gift list, and all that’s left is the shopping. A few more tips: Remember to be timely with your employee recognition. Get to know your employees so you can identify what motivates them. Reward risk taking as well as results. Develop an effective system of recognition for your staff. Throw in the new performance bonuses USA Hockey agreed to pay the players and their income could rise to six figures annually if  they win the Olympic gold medal  or world championship.”At least 20 U.S. senators signed a letter to USA Hockey prior to the negotiation stating: “These elite athletes indeed deserve fairness and respect and we hope you will be a leader on this issue as women continue to push for equality in athletics.”With the hashtag #BeBoldForChange and the social media slogan of “1 Goal, 1 Team, 1 Dream,” the hockey team models the efforts of every woman trying to get paid what she is worth and close the pay gap.True, you are likely not a professional athlete headed to the 2018 Olympics, an d an individual’s salary talk with an employer or client does not make sports headlines, but the women’s hockey team’s quest for “a reasonable path forward” to close the pay gap is at the heart of every sit-down about money and the future.“By failing to routinely negotiate our salaries, we lose more than $1 million by the time we retire,” according to She Negotiates, a powerhouse in resources, training and events for women looking to be paid fairly.And who isn’t?While many states are working toward that goal, all women in America earn an average of 80 cents for every dollar that a man earns for the same work with the same title.According to a press release about a recent study in the Journal of Economic Behavior Organization, “Women underestimate their earnings prospects, leading to lower expectations and little inclination to push for higher wages or promotion, or seek a better paid position.”And they take what they’re offered.
