Kelley Clements Keller is the owner and managing member of The Keller Law Firm, LLC, a boutique firm practicing intellectual property (IP), which includes assisting clients in IP prosecution, procurement and maintenance, licensing and enforcement, brand expansion and management, domain name and Web site matters, social media issues, and IP-related business matters. 6:30 a.m.: I begin each day with coffee with my husband. Once I put the coffee on, I check my e-mail to see what is brewing for the day. This is my first engagement with the dayâs material. I send out responses to the messages that require immediate response, and shoot out e-mails to the staff, letting them know about the new projects that need to be added to the queue. 8:30 a.m.: I arrive at the office already aware of the business for the day. I review my calendar and prioritize, and then I check in with my attorneys and staff- the law clerks, my paralegal, and my research assistant. The purpose of this crucial part of my morning is to ensure that everyone is on the same page, and that each person has the tools that they need to succeed in their assignments. 9:00 a.m.: I give one of my law clerks an office action refusal from the U.S. Patent and Trademark Office (PTO) for one of our clientâs trademark applications for him/her to begin researching and drafting a response. Itâs a difficult argument to make, as it requires us to prove that our clientâs house mark is descriptive, as opposed to generic, in order to secure federal protection. 9:30 a.m.: I am counsel in an interesting trade secret action where the defendant did not file an answer to the federal complaint. I place a call to a colleague to discuss the status of the case, since two heads are always better than one. I have come to learn that no matter how long you practice law, you never âexperience it all.â We debate the likelihood of whether our client can recover attorneysâ fees under the circumstances, e.g., a request for default was entered by the Clerk of Court and a motion for default judgment is pending with the judge. Because the defendant failed to answer, the case law is a bit murky on how much our client can recover, if anything at all. Itâs a very interesting fact pattern! 10:00 a.m.: Iâll spend the next few hours in phone conversations with clients, court personnel, offices (such as the PTO), or in outreach, marketing, and business development. When not on the phone, Iâm sending and responding to numerous e-mails. When I encounter particular situations that reflect important principles in IP, I like to call my staff together for a quick tutorial. Such situations represent opportunities for learning, and my role as a teacher and mentor to my staff is very important to me as it gives me the opportunity to demonstrate why these principles result in predictable outcomes. 10:30 a.m.: I need to make a call to the PTO to handle a clarification of a clientâs identification of goods with the examining attorney assigned to their trademark application, and ask my paralegal and one of my law clerks to step into my office and listen to the call for learning purposes. This is something I often do and find that my staff is more knowledgeable of files they work on as a result of it. The examining attorney enters the requested changes into the record, and my paralegal knows that she needs to draft a reporting letter to the client regarding this activity. 11:00 a.m.: Being the owner of the firm, I also have to manage the business in addition to practicing law. I have my usual daily meeting with my comptroller and get a financial update on our receivables and payables. In a given day, I might also spend an hour on the phone with my certified public accountant on various financial matters. If there are IT issues, I ask someone on the staff to contact our service providers to handle them. If there are any building issues, e.g., problems with heating, these also require my time and attention. Itâs surprising how much time can be spent on the âbusiness of law,â rather than the âpractice of law.â 12:00 p.m.: Lunch is a time for business development, and when Iâm not eating with the staff (or at my desk- a âno noâ), I spend this time meeting with colleagues to work on collaboration or marketing, or meeting with potential clients. In the afternoon, I continue with more phone calls and e-mails, research for my caseload, and drafting letters to clients, opposing counsel, or relevant agencies 12:45 p.m.: I prepare for an initial consultation meeting and review my notes from my phone conversation with the new client. At this time, I am unaware of the potential clientâs product, but do know that she thinks patent protection applies. We will know more after the consultation. 1:00 p.m.: The potential client arrives and our meeting begins. I soon realize that trademark protection is most applicable, possibly copyright, but definitely not patent. Intellectual property is a confusing area of law to many, so initial consultations can be very educational. We discuss the product she wants to take to market, her overall branding goals, and how I can assist her in accomplishing these goals. We also discuss finances related to the representation. 2:00 p.m.: With the meeting fresh in my mind, I draft a follow-up e-mail to the potential client, confirming what was discussed as well as laying out her various legal options. I find these e-mails give clients a good picture of the strategy that we outlined and how to plan accordingly. 3:00 p.m.: I continue to work on pending matters, such as follow-up e-mails with clients, at present drafting a motion for attorneysâ fees in the trade secret infringement case, and reviewing/approving client correspondence that my paralegal has prepared. Itâs not uncommon for my mornings to be full of client phone calls, e-mails, and meetings, leaving the afternoon for knocking out substantive legal work. 5:00 p.m.: I e-mail the draft motion for attorneysâ fees to co-counsel for his review. Co-counsel responds and would like to set up a time to connect at the end of the week. 6:00 p.m.: I begin to wrap up my work for the day and shut down the office, taking care of issues from pressing business and legal matters to mundane tasks such as doing dishes, washing out the coffeemaker, and turning out the lights (welcome to owning your own firm!). I also like to acknowledge the work completed by my staff, so I shoot off a final few e-mails before calling it a day around 7:00. Off to dinner with my husband, glass of Shiraz in hand!

Millennials want to do things in ways that Generation X and the baby boomers may not agree with, and that often causes friction. Many companies are so focused on the what of the matter that they may be missing out on the why. Older executives often find it easy to dismiss the millennial generation as lazy or unmotivated, but that simply isnt the case. Millennials grew up in the age of the internet; for as long as they can remember, theyve been able to talk to anyone from anywhere at any time. They keep their professional email accounts connected to their personal cellphones, and they perform one-off work tasks at all hours. They want to wear comfortable clothes to work, and they want to work at least some of the time from home. Many millennials got participation trophies in their soccer leagues just for trying their best; theyve learned from an early age that rankings dont matter much. Thats why the office hierarchy means less to them, as does the prospect of climbing the corporate ladder. They want environments where ideas and effort rule more than people do. These ideas that millennials hold about work arent bad â" theyre just different from the traditional notions that boomers are so used to. While the two generations might view the workplace in different ways, learning to reconcile the two ideologies with one another will bring benefits to any employer that supports the effort. Millennials are starting their careers at a time when digital and cultural shifts have created a blending of work and life, says Sherry Dixon, senior vice president at employment agency Adecco Staffing USA. Nine-to-five schedules are becoming a thing of the past, while smartphones and cloud-based platforms are holding workers accountable for to-do lists, deadlines, and hot requests at all hours of the day. Many millennials are willing to stay connected and responsive outside of the eight-hour work day, but they may also expect employers to be more lenient when they need to work from home or take an afternoon off at the last minute. As long as young people have established trust, accountability, and consistent communication with their managers, this new dynamic can work in both the employees and employers favor. Meeting of the Minds If boomers and millennials have limited interaction, theyll never find out how much they can learn from each other. Companies that encourage employees to close the generational gap will reap some serious rewards Programs that foster idea-sharing are often used as a tactic to strengthen workplace culture, but they are also great ways for businesses to absorb technical know-how from millennial workers, Dixon says. Companies can also implement reverse mentoring programs, where executives spend time with less-tenured employees to hear their fresh perspectives. Besides reverse mentoring, businesses can implement additional programs that encourage employees to teach one another across generational lines. Companies can leverage young workers by conducting quarterly lunch and learns, Dixon says. During these sessions, an office orders in lunch and dedicates the hour to an employee or team who will share best practices or introduce new topics. These not only generate positive morale, but can also tap into millennial expertise. Millennial Wanderlust When you have top millennial talent on your roster, you want them to hang on to their jobs the way baby boomers did in days of yore. But thats easier said than done. Millennials arent just known for changing jobs â" they also like to change locations. People are not getting married and settling down as young as they used to, allowing them to pick up and move more easily, Dixon says. Adeccos recent Way to Work survey found that 53 percent of people between the ages of 18 and 24 expect to move to 2-3 cities throughout their careers. On top of that, millennials have grown up in the age of startups and many seem to possess a more entrepreneurial spirit, which may be contributing to their desire to experience different career opportunities and new geographies â" especially in places like Los Angeles and New York that are home to notable fast-growing and forward-thinking companies, Dixon says. Millennials consider the opportunity for growth a top concern at the start of their career journey. In the Way to Work survey, 36 percent of young people said growth was a top priority in their job hunt. It makes sense that millennials would be driven to seek out new work environments in order to keep expanding their skill sets and advancing in their careers, Dixon adds. While that fact may make any effort to get millennials to stay at one company seem futile, the truth is that millennials are interested in staying at companies where they feel engaged and appreciated. No matter the industry, companies must provide transparent and consistent feedback to millennials in order to keep them engaged, Dixon says. They need to know how their particular responsibilities are contributing to the bottom line and that they are adding value to the organization. Any doubt that they are making a difference, and they will look for other options to ensure they are investing their time where it counts. And this doesnt mean that millennials only want positive feedback; in their pursuit to advance, they are looking for ways to improve their performance. Most importantly, businesses must remember that they dont have the upper hand in the current job market. In todays economy, candidates and employees can always seek other opportunities. Companies are recruiting in a job seekers market right now, so competitive compensation packages are a must, Dixon explains. But salary isnt the end of the conversation. Once an employer gets millennial talent in the door, a winning workplace culture is necessary in order to get them to stay put. Read Before BedA study published in Psychological Science- which explored strategies for improving memory- discovered that sleeping in-between learning sessions not only reduced the amount of practice needed by half, but also increased long-term retention of information. 5During the experiment, the researchers split 60 French-speaking participants into three different groups: a control group, sleep group and no sleep group.Each of them were assigned with the task of learning and remembering French translations of a list of 16 Swahili words.The Control group studied the words in the evening and took the memory test 12 hours after sleeping.The Sleep group also studied the words in the evening and took the memory test 12 hours after sleeping. However, they studied the words a second time.Finally, the No Sleep group studied the words in the morning and took the memory test 12 hours later without sleeping in-between study sessions. Always Keep Learning No one, not even the absolute upper crust of a company hierarchy, knows everything there is to know about business or a particular industry. There is always room to continue learning and growing. Continued education means building your skills and deepening your understanding of the field so that you can progress toward higher levels. Perhaps you can take a professional development class, receive a certification or even go back to school by taking night, weekend and/or online courses. Any one (or combination) of these are sure to help you learn new information that can be applied to your career field. 2. Be Open to Ideas You are going to learn a lot even if you arenât in a formal training session. By opening yourself to what your boss, superiors, coworkers and even customers have to say, you can obtain tremendous insight into the way that your position is evolving and what you can do to ensure that you are moving in the right direction. Pay attention during staff and/or company meetings and listen to everyones ideas. Adhere to any feedback from your manager (especially around evaluation times) or even directly approach your manager and ask him/her how you can improve in your role. If you supervise an accounting team, be sure to offer your appreciation with rewards and recognition. Why? Most businesses canât survive without a trusted accounting professional. From your staff accountant to your senior accountant, these folks keep the books balanced and taxes filed. As businesses grow, so do the rules and regulations they must follow, and their need for technical expertise multiplies. Itâs worth taking a moment on this auspicious day to learn some surprising facts about accountants and give thanks to them appropriately. (See our Slideshare, below.) Why auspicious? International Accounting Day (or International Accountants Day) is celebrated yearly on November 10. Thatâs the date in 1494 when Venetian mathematician Luca Bartolomeo de Pacioli published an epic tome that included an in-depth look at bookkeeping practices. If youâre looking for a less complicated form of recognition, a thank-you card, flowers or balloons may be appropriate. But with just a little more effort, your gestures can be more thoughtful - showing your staff accountants just how much you value their work. Here are few suggestions: 1. Gift certificates Personalizing each certificate is key, whether itâs a restaurant gift card or something more creative. Say your accounting clerk is an avid mystery novel fan. In that case, a gift card to your local independent bookstore would be a thoughtful way to say âthank you.â Or maybe your payroll manager is a football fanatic and would enjoy tickets to a local collegeâs game. 2. Cash and perks A bump in the paycheck is always a nice show of appreciation. Are you up to date on the pay ranges for finance and accounting positions?
